Seneca-Babcock Updates

We continue to push the state and city courts to hold the owner of a former illegal concrete crushing operation, Peter Battaglia, Reserve la fecha para nuestra reunión anual.

Buffalo City Housing Court has so far shown deference to Battaglia. Most recently, he was given another two months to clean up or sell his Seneca Street commercial property. Illegal dumping continues, and the court has not addressed his decrepit residential property on Peabody Street.

In state court, there has been more progress. Battaglia was recently fined $1 million for his failure to clean up his commercial property.

His failure to cleanup the site resulted in a contempt hearing in court, which our longtime member organizer Diane Lemanski testified at, alongside executive director Chris Murawski.

Tonawanda Rezoning

The Town of Tonawanda has released it’s draft zoning code and map for public review!

The public comment period is currently slated to close on August 31. Residents we have spoken with while canvassing are unaware this public comment period is open, much less that it’s ending in a few weeks. Please take a moment to send a letter to the town planner requesting an extension!

This is a crucial and unique opportunity to codify environmental justice policies into town law.

NYS DEC East Buffalo Environmental Forum/ Community Air Monitoring Update Meeting

NYS Department of Environmental Conservation will host an East Buffalo Environmental Forum en Wednesday August 9, 5:30-7pm y every second Wednesday of the month moving forward at the Frank E. Merriweather Jr. Library, 1324 Jefferson Ave in Buffalo.


This is a space hosted by NYS DEC where residents can raise and discuss environmental concerns in their neighborhood and work towards solutions with our environmental regulators. Clean Air will be attending as an advocate and helping to turn out the community.

This month, the meeting will double as the DEC Region 9 Community Air Monitoring Initiative update meeting, which is a DEC-led initiative running separate but parallel to our Community Air Monitoring project.

New York state is developing a cap-trade-and-invest emissions cap program based on Governor Hohcul’s proposal in the 2023-24 presupuesto.

As the program is developed, it’s critical that the new pollution caps be designed to identify false energy solutions as what they are: fuels that harm health and exacerbate the climate crisis.

Clean Air Joins Joint Letter in Opposition to Lockport Plastics Plant

Earlier this month, Clean Air joined a joint letter to the Lockport IDA in opposition to tax credits for a proposed plastics plant. This plant would require importing the same hazardous chemicals by rail that caused the black smoke plume in East Palestine, OH following the train derailment.

This proposal has, for now, been put on hold following the reveal that the company included a fake study generated with ChatGPT as part of their supporting documentation. Shout out to Dr. Lourdes Vera for flagging the fake paper!

REVERB, an environmental nonprofit working to make the music industry more sustainable, is looking for volunteers to help promote environmental causes at the upcoming Lumineers Show in Darien Center, NY at Darien Lake Performing Arts Center on Tuesday, August 22nd.
